Terms of Use

These Terms govern your use of GetBanaya. They explain what we do, what you agree to when you buy or sell here, how money is held and released, and who is responsible for what. Please read them before you place or accept an order.
1. Acceptance and eligibility
By accessing or using GetBanaya (the "Platform"), you agree to these Terms of Use and to our Privacy Policy and Refund & Escrow Policy, which form part of these Terms. If you do not agree, please do not use the Platform.
You must be at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872. If you use the Platform on behalf of a business, you confirm that you are authorised to bind that business to these Terms.
2. What GetBanaya is
GetBanaya is a marketplace that connects independent Indian creators ("Creators") with buyers ("Buyers") for custom, made-to-order and handmade products. We provide the storefront, the order and messaging tools, and the payment and escrow rails.
We are an intermediarywithin the meaning of the Information Technology Act, 2000. Every contract of sale is between the Buyer and the Creator. GetBanaya does not manufacture, design, inspect, store or ship any product listed on the Platform, and does not own the goods at any point. Where these Terms give us a role — holding funds in escrow, deciding a dispute — we perform it as the operator of the Platform, not as a seller or a guarantor of any Creator's work.
3. Your account
An account is created with your name, a username, an email address and a password. You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly at support@getbanaya.in if you believe your account has been compromised.
The Platform has three roles: Buyer, Creator and Admin. Every account starts as a Buyer. Selling requires completing Creator onboarding, including identity verification (currently Aadhaar-based verification through DigiLocker) and providing payout details, before any listing goes live or any payout is released.
Please keep your details accurate. One person or business should hold one account; accounts may not be sold or transferred.
4. Creator obligations
If you sell on GetBanaya, you agree that:
- You have the right to sell what you list, and the goods do not infringe anyone else's intellectual property or violate Indian law.
- Listings are honest — accurate photographs, materials, dimensions, customisation options and lead times. Made-to-order lead times must be ones you can actually meet.
- Listed products meet the Platform's minimum order value of ₹499.
- You respond to Buyer messages and design approvals within a reasonable time, and you follow the custom-order workflow in Section 6.
- You are responsible for your own tax registration, invoicing and compliance, including GST where it applies to you. GetBanaya does not provide tax advice.
- You fulfil accepted orders, or cancel them promptly and honestly if you cannot.
5. Buyer obligations
If you buy on GetBanaya, you agree to:
- Provide accurate delivery and contact details.
- Respond to mockups and design approvals within a reasonable time — a custom order cannot move into production until you approve it.
- Pay the amounts due at checkout, including, for Cash-on-Delivery orders, both the advance and the balance collected on delivery.
- Raise any problem with an order through the Platform's dispute process rather than by chargeback in the first instance, so the Creator has a fair chance to put it right.
6. Custom and made-to-order products
Custom work follows a structured flow: design brief → mockup → Buyer approval → production → delivery. For escrow-eligible orders, your payment is held and is not released to the Creator until the milestones described in the Refund & Escrow Policy are met.
Because these items are made to your specification, they are not returnable simply because you changed your mind once production has begun. Your protection is the approval step: review the mockup carefully, and ask for changes before you approve it.
7. Prices, platform fees and taxes
Creators set their own prices, subject to the ₹499 minimum order value. Prices shown to Buyers are in Indian Rupees and include the Creator's price for the item; shipping and any taxes are shown at checkout before you pay.
GetBanaya charges the Creator a 10% platform commission and a 5% transaction feeon each order. These are deducted from the Creator's payout, not added to the Buyer's total. Fee calculation happens on our servers at checkout; the amount you are charged is always computed by us and never supplied by your browser or app.
Each party is responsible for its own taxes. Where GST applies to our fees or to a Creator's sales, it is charged at the rate prescribed by law at the time of the transaction.
8. Payments, escrow and payouts
Payments are processed by our payment partner, Razorpay. GetBanaya never sees or stores your card, UPI or bank credentials.
For escrow-eligible orders, funds are held rather than paid straight to the Creator, and are released, partially released or refunded according to the Refund & Escrow Policy. Escrow status changes only through a verified payment-provider notification or an explicit administrative action; it cannot be triggered from a Buyer's or Creator's device.
Cash-on-Delivery orders are split: a 40% advance is collected by UPI when the order is placed, and the remaining 60% is collected on delivery.
Payouts are made to the bank or UPI details a Creator has verified. We may delay or withhold a payout where an order is under dispute, where we reasonably suspect fraud, or where we are required to by law.
9. Prohibited conduct and items
You may not use the Platform to:
- Break any law, or list goods whose sale is restricted or prohibited in India — including weapons, drugs, tobacco, wildlife products, hazardous materials, counterfeit goods and sexually explicit material.
- Infringe anyone's copyright, trademark, design or other rights, including replicas of branded goods.
- Take payment or move a transaction off-Platform to avoid our fees or our escrow protection. Doing so removes the Buyer's protection and is grounds for removal.
- Post false, defamatory, hateful or harassing content, or manipulate reviews and ratings.
- Probe, scrape or interfere with the Platform's security, infrastructure or other users' accounts.
10. Intellectual property
The Platform. The GetBanaya name, logo, software and design belong to us. Using the Platform gives you no right to reproduce them.
Your content. You keep ownership of everything you upload — listing photographs, product descriptions, portfolio images, design briefs and messages. By uploading, you grant GetBanaya a non-exclusive, royalty-free, worldwide licence to host, display, resize and distribute that content for the purpose of operating and promoting the Platform. This licence ends when you delete the content, except for copies we must retain for legal or dispute-resolution reasons.
Commissioned custom designs. When a Buyer commissions and pays for a bespoke design, ownership of that specific commissioned work passes to the Buyer on full payment and release of escrow. The Creator retains ownership of everything underlying it — their style, techniques, tools, templates, motifs and any pre-existing material they brought to the commission — and may continue to use those freely in other work. Unless the Buyer asks otherwise in writing, the Creator may display the finished piece in their portfolio and marketing.
Complaints. If you believe content on the Platform infringes your rights, write to grievance@getbanaya.in with details of the work, the listing complained of, and a statement that you are the rights holder or authorised to act for them. We will review and, where appropriate, remove the content and notify the user who posted it.
11. Moderation, suspension and termination
We may remove a listing or piece of content, or suspend or close an account, where we reasonably believe these Terms have been broken, where there is fraud or risk to other users, or where we are required to by law. Where it is practical and lawful to do so, we will tell you why and give you a chance to respond.
You may close your account at any time. Closing it does not cancel orders already in progress, release escrowed funds early, or end obligations that by their nature survive — payment for goods received, and Sections 10, 13, 14, 15 and 17.
12. Reviews and ratings
Reviews may be left only by a Buyer who actually placed the order being reviewed. Reviews should be honest and about the product or the transaction. We may remove reviews that are abusive, off-topic or incentivised, but we do not remove a review simply because a Creator dislikes it.
13. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free.
We do not manufacture or inspect the goods sold here. Creator verification, ratings and our dispute process reduce risk but are not a guarantee of any Creator's workmanship, materials or delivery times. Nothing in these Terms excludes any right you have as a consumer under the Consumer Protection Act, 2019 or other law that cannot be excluded by agreement.
14. Limitation of liability
To the maximum extent permitted by law, GetBanaya is not liable for indirect, incidental, special or consequential loss, or for loss of profits, goodwill or data, arising from your use of the Platform or from goods sold by a Creator.
Our total liability to you in connection with any order is limited to the amount you paid for that order. Our total liability to you in connection with the Platform generally, in any twelve-month period, is limited to the greater of the amounts you paid to us in fees in that period and the value of the order giving rise to the claim.
These limits do not apply to liability for fraud, or for death or personal injury caused by our negligence, or to any liability that cannot be limited under Indian law.
15. Indemnity
You agree to indemnify GetBanaya against claims, losses and reasonable legal costs arising from your breach of these Terms, from content you post, or — if you are a Creator — from the goods you sell, including claims that they are defective, unsafe or infringing.
16. Grievance redressal
Start with the dispute process on your order page — it is the fastest route and gives the Creator a chance to fix the problem. If that does not resolve matters, contact our Grievance Officer:

We acknowledge complaints within 48 hours and aim to resolve them within 15 days, as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to Section 16, the courts at Chennai shall have exclusive jurisdiction over any dispute arising out of or in connection with them.
18. Changes to these Terms
We may update these Terms as the Platform develops or the law changes. We will update the effective date above, and will give notice of material changes through the Platform or by email before they take effect. Continuing to use the Platform after that constitutes acceptance. Orders already placed remain governed by the Terms in force when they were placed.
